Too few of us get round to making a will. Failing to do so can lead to unexpected consequences, and a great deal of distress for those left behind. For example, couples who live together without getting married now have some succession rights, but these aren't clearly set down in law. If the partner who dies owns the house, the other partner would have to raise a court action to ask that the house be transferred into their name. The outcome wouldn't be guaranteed, and the court case could cost a lot of money and take several months. In the meantime there would be worry and uncertainty. Many people just don't realise the risks of not leaving a will. Livingstone Brown is ideally placed to help you draft a will. Our partners and solicitors all have considerable experience in this area. Our award-winning IT systems enable us to draft wills accurately and quickly. Your will can be as simple or as complicated as you like, provided it satisfies the basic legal requirements and clearly expresses your wishes. It's always safer to have a will prepared by a solicitor - the packs that can be bought in the shops might be designed for another legal system (e.g. America or England), and a solicitor can help check that you haven't missed anything. It doesn't cost as much as you might think - our basic will package starts at £85 plus VAT. Payment can be made by credit or debit card. Legal aid may even be available. For a detailed quote, without cost or obligation, just contact your nearest office. From the other point of view, dealing with the estate of a loved one can be very upsetting, and at the same time difficult and drawn-out. Getting professional help can ease the burden. A solicitor can help deal with the administration of the estate, including registering the will, having an executor appointed if there isn't one, finding out what assets and liabilities there are, applying for the court's approval to proceed (known as Confirmation) and settling up with beneficiaries. To find out more, simply contact one of our solicitors. We'll tell you, without any obligation, what work would be involved and how much it would cost. Usually there's no need for up front payment of fees - instead, these can be deducted from the estate once everything has been ingathered.
