The Specialist Litigation Team was instructed by individual, Susan Sinclair, in relation to her involvement in the Post Office Horizon IT Scandal, which has been commonly described as the largest miscarriage of justice in UK history. Ms Sinclair was wrongfully convicted of embezzlement based upon the Crown’s reliance on faulty Horizon data back in early 2000s. The case was referred by the Scottish Criminal Cases Review Commission (SCCRC) to the Court of Criminal Appeal, and the team was ultimately successful in securing the quashing of her conviction in September 2023, which was one of the first Post Office convictions to be overturned in Scotland. Her case was the only SCCRC referral that involved a conviction after trial.
Following this, the Scottish Government passed the Post Office (Horizon System) Offences (Scotland) Act 2024, quashing the convictions for those who met certain criteria, without having first to go to court.
