The Specialist Litigation Team played a significant role in the case of Keir & Daly v HMA [2025] UKSC 38, having been jointly instructed by the Law Society of Scotland and the Faculty of Advocates as third party interveners before the UK Supreme Court.
In the judgment, the Law Society of Scotland and the Faculty of Advocates appeared as the first intervener, with the team including Counsel (the Dean of Faculty Roddy Dunlop KC, Claire Mitchell KC, David Welsh Advocate) and solicitors, Stuart Munro and Sarah Cunningham Munro.
The intervention assisted the court by offering the Law Society and Faculty of Advocate’s views on the current application of the legal protections afforded by section 274 and section 275 of the Criminal Procedure (Scotland) Act 1995, particularly regarding the balancing act of protecting the interests of complainers and safeguarding the accused’s right to a fair trial. This placed Livingstone Brown at the centre of a landmark case that reshaped the admissibility framework for evidence in sexual offence prosecutions across Scotland, and the team’s instruction to act on behalf of both professional bodies highlights its reputation within the profession.
