Livingstone Brown represented diabetic nurse in her Employment Tribunal claim against her employers who dismissed her for taking a glucose solution at work.
Clair, who has diabetes, had taken the solution to avoid a ‘hypo’ but was sacked for gross misconduct. However, after eight days of evidence, the ET said the investigation by her employers was fundamentally flawed and they did not believe some of the evidence given by GPs who worked at Armadale Medical Practice, West Lothian.
The Tribunal in Edinburgh awarded Clair the sum of £38,000 for unfair dismissal.
