Damp Housing Claim Blog

Livingstone Brown successfully settles a damp housing claim for one of their clients. 

John Barnes, paralegal in the Personal Injury Department, successfully settled a claim against a housing association for a five-figure sum.

Our client was moved into her property in October 2018 by the Housing Association as she was fleeing domestic violence.  There was water leaking in the kitchen coming from the walls and ceiling.  The living room was also flooded at one point.  There was leaking coming from the ceiling onto the lightbulbs which caused sparks.  The client was calling the Housing Association every week and plumbers came out to the property and advised they were unsure where the leakage was coming from. It took them two years to realise it was coming from the pipes in the walls.  The pipes were replaced and the leaking started again. 

She had then met with her local MP who wrote to the Housing Association who replied that there was no leakage and it had been repaired.  She thereafter instructed Livingstone Brown to pursue a claim of damages. After two years of trying to remedy the matter herself, she contacted our office looking for advice and after our instruction, liability was admitted on behalf of the Housing Association which resulted in a five figure settlement.
